The First Symposium on Mediation, Arbitration and Shanghai Free Trade Zone Dispute Resolution took place on July 13, 2015 in Shanghai. It was organized by the Shanghai University of Finance and Economics School of Law, the Collaborative Innovation Center of China(Shanghai)Free Trade Zone and by the SUFE Free Trade and ADR Research and Development Centre and kindly sponsored by the Consulate General of the United Kingdom in Shanghai and by the Shanghai Municipal Commission of Commerce..
Martin Svatoš, Ph.D. was invited to participate as a speaker and as a moderator of one of the panels. His contribution entitled the Blend of Judicial Mediation and Arbitration addressed the issue of interaction between those consensual and adjudicatory ADRs. He mentioned not only the common features of those dispute resolution procedures but also the mutual beneficial use of mediation in arbitration and vice versa (e.g. baseball arbitration in mediation procedures and mediation windows in arbitration).
Among other speakers, one should mention Danny McFadden (Managing Director, CEDR Asia Pacific), Sylvia Tee (Director of ICC Arbitration and ADR, Asia) and Professor Carrie Shu Shang (Executive Director at SUFE Free Trade and ADR Research & Development Center).
The audience comprised the leading lawyers, academics and arbitrators not only from PRC, but also from Hong Kong and Singapore. You may read more about Dr. Svatos’ contribution on Kluwer Mediation Blog and you may download the pdf of his presentation here.
